AGREEMENT ON THE PROCESSING AND STORAGE OF PERSONAL DATA ACCORDING TO REGULATION (EU) 2016/679 APPLICABLE FROM 25 MAY 2018

The commercial company / natural person (the client) accepts the processing and storage of the personal data communicated to LUXCONSTRUCT CONSTANTINO S.R.L. (personal identification number, VAT/tax ID, Trade Register no., address, telephone number), under the following conditions:

1. The legal basis for the processing/storage of these personal data (name, address, personal identification number, telephone, email, bank, bank account) consists of the contracts signed and the applicable legal provisions.

9. The Beneficiary (client) has the right to object in writing to the processing of personal data (for example, if the purpose of processing is direct marketing, etc.).

Right to object – the right to object to the processing of personal data if the processing is necessary for the performance of a task carried out in the public interest. Also, if the processing of personal data is carried out for direct marketing purposes, you have the right to object at any time to such processing.

10. The Beneficiary (client) has the right to correct in writing inaccurate personal data.

Right to rectification – you may request the rectification of certain personal data if they are incomplete or inaccurate. Thus, depending on the purpose of the processing, you may complete and then send the personal data that are missing or incorrect, it even being possible to complete a declaration for conformity.

11. The Beneficiary (client) has the right to request in writing the deletion of personal data if they are no longer necessary for the purposes for which they were collected or processed and if there is no other legal basis for further processing of these data.

Right to erasure (“right to be forgotten”) – you may request that the data be erased, without undue delay, if any of the following situations occur: the data are no longer necessary for the purposes for which they were collected or processed; you withdraw your consent and there is no other legal basis for processing; you object to processing and there are no overriding legitimate grounds; personal data have been unlawfully processed; personal data must be erased for compliance with a legal obligation; personal data have been collected in relation to the provision of information society services.

12. The Beneficiary (client) may restrict the processing of personal data if he/she contests the accuracy of the data, for a period enabling the Provider to verify the correctness of the data.

Right to restriction of processing – you have the right to request the restriction of data for a period of time, for example where the decision has been taken to erase your data and you consider that they are useful to you in different situations, such as exercising a right in court. Also, if you contest the accuracy of the data or if the processing is unlawful, you may request the restriction of the data. Thus, upon receiving a request from you and after verifying it, we will stop processing the personal data for a certain period.

13. This agreement applies to any personal data communicated by the Beneficiary (client) during the validity of the contracts signed with LUXCONSTRUCT CONSTANTINO S.R.L., both before and after the signing of this agreement, under Regulation (EU) 2016/679 applicable from 25 May 2018.

14. The Beneficiary (client) has the right (Right to data portability) to receive the personal data in a format that can be read automatically and that allows the data to be transmitted directly to another controller.

15. The Beneficiary (client) has the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing when he/she finds that his/her rights regarding the processing of personal data have been infringed.

16. Transfer of personal data outside the EU – Your data will not be transferred to countries outside the EU.

17. Data security

The data received from you are stored on servers that have implemented security measures such as: detection of security breaches and their causes, recovery of personal data and limitation of security breaches.

In the event that a breach of the security of your personal data is found, we will inform the management of the company that owns the servers so that the necessary measures can be taken to restore data security, notifying the Supervisory Authority about the security incident if it is suspected that the breach of security may lead to a high risk to the rights and freedoms of the individuals whose personal data security has been affected.
